Terms & Conditions

1. Scope of Application

These Terms and Conditions (T&C) apply to all orders placed by customers via the Monsieur Nia online shop. Deviating terms and conditions of the customer will not be recognized unless explicitly agreed to in writing.

2. Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.

By clicking the “Buy Now” button, the customer submits a binding offer to conclude a purchase contract.

The contract is concluded once Monsieur Nia accepts the order by sending an order confirmation via email.

3. Product Characteristics

The products offered are fresh caviar, which must be shipped in a refrigerated state.

As a sensitive and perishable food product, slight variations in color, texture, and taste may occur.

4. Delivery & Shipping

Shipping is carried out exclusively in a refrigerated state and in appropriate packaging to ensure freshness.

The estimated delivery time will be displayed to the customer before the order is finalized.

If delivery fails due to incomplete or incorrect address details provided by the customer, the customer shall bear any resulting additional costs.

5. Prices & Payment Terms

All prices are final prices and include the applicable statutory VAT, unless otherwise stated.

The customer may choose from the payment methods offered during the checkout process.

6. Right of Withdrawal & Exchange

According to § 312g para. 2 no. 2 BGB, the right of withdrawal does not apply, as the goods are perishable food items.

Therefore, exchanges or returns of caviar are excluded.

7. Liability & Storage

Monsieur Nia ensures proper refrigeration and packaging up to the point of handover to the customer.

From the moment of delivery, the customer is responsible for proper storage and refrigeration.

Liability for damages or quality loss due to improper storage by the customer is excluded.

8. Warranty

The statutory warranty rights apply unless otherwise stipulated in these Terms and Conditions.

9. Data Protection

The processing of personal data is carried out exclusively in accordance with the applicable data protection regulations. Details are outlined in the privacy policy.

10. Final Provisions

German law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

If legally permissible, the place of jurisdiction shall be the registered office of Monsieur Nia.

Should any provision of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
